Terms of Sale & Use

These terms apply to every product Geenaro sells or gives away on geenaro.com and in the store at drumkits.gg: audio plugins such as SampleBridge and OneShotPlayer, drum kits, sample packs and other digital products, including trials, betas and free downloads. By buying, downloading, installing or using a product you agree to these terms. Checkout and payment on drumkits.gg are handled by Sellfy and its payment providers, whose own terms also apply to the payment.

2. Digital Products and Delivery

All products are digital. They are delivered as a download or as a license key right after payment. Plugin downloads and trials are on geenaro.com/plugins and need a Discord account; license keys arrive by email. Product pages describe what is included and which systems are supported. Please check the system requirements, and for plugins the free trial, before you buy. Keep your own copies of everything you download.

3. All Sales Are Final

Because every product is digital content that is delivered immediately, all sales are final and purchases are not refunded. By completing your order you expressly ask for delivery to start before the end of the withdrawal period and you acknowledge that you lose your right of withdrawal as soon as delivery has started (for consumers in the EU, Section 356(5) of the German Civil Code and Article 16(m) of Directive 2011/83/EU). There are no refunds for a change of mind, an accidental or duplicate purchase you did not report before downloading, a system the product page does not list as supported, or not using a product. Your statutory rights for defective products (section 8) are not affected.

4. Subscriptions

  • Subscriptions are billed in advance for each billing period through Sellfy. A one-time setup fee, where shown, is charged with the first payment.
  • You can cancel at any time in your Sellfy account or through the link in your purchase email. Cancelling stops future payments; you keep access until the end of the period you have already paid for. Periods already started and setup fees are not refunded.
  • When a subscription ends, the plugin stops working once its last license check runs out.
  • Price changes apply only from the next billing period after you have been told about them. If you do not agree, you can cancel before then.

5. Your License

Products are licensed to you, not sold. You get a personal, non-exclusive, non-transferable license that you may not sublicense, for as long as you keep to these terms and, for subscriptions, while the subscription is paid.

Plugins

  • One license may be active on as many computers at a time as the product page or the plugin states (currently two).
  • Do not share, publish, sell or give away your license key, and do not let other people use your license.
  • Do not crack, bypass or tamper with the license checks, and do not decompile, disassemble or reverse engineer the software except where the law expressly allows it. Do not redistribute the installers.

Drum Kits, Samples and Presets

  • Unless the product page says otherwise, you may use the sounds in your own music, including commercially released music, without paying royalties and without credit.
  • You may not resell, share, upload, give away or offer the sounds as they are or in another sample pack, sound library, preset bank, construction kit or similar product, even if you change them.
  • You may not use the sounds to train or improve artificial intelligence or machine learning systems, and you may not register the sounds themselves (rather than your finished song) with Content ID or other audio fingerprinting services.

If you break these terms, your license ends automatically and Geenaro may deactivate your license key. The same applies to fraud and to chargebacks or payment reversals that are not justified; in that case Geenaro may also claim the fees and costs it causes.

6. Trials, Free Products and Betas

Trials, free downloads, free or extended licenses, member downloads and beta versions (such as the Windows beta) are voluntary and free of charge. They are provided as they are, may be changed, limited or ended at any time and give no right to keep using them. Beta versions are unfinished, may be unsigned and may contain errors: use them at your own risk and back up your projects first. Free licenses granted at Geenaro's discretion can be withdrawn if these terms are broken.

7. Activation, Online Checks and Availability

Plugins need an internet connection to activate and to check their license from time to time; they keep working offline only for a limited time. Geenaro aims to keep the license servers, downloads and the Discord community available but does not guarantee that they are always available or free of errors. Maintenance and services run by others (for example Sellfy, Discord or hosting providers) can cause interruptions. Updates of operating systems and music software can affect compatibility; beyond the updates the law requires, there is no right to new versions or new features.

8. Warranty

If you are a consumer, your statutory rights for defects apply. If you buy as a business, products are provided as they are and, to the extent permitted by law, any warranty is excluded, except for defects concealed fraudulently and for guarantees given in writing; any remaining claims expire one year after delivery.

9. Liability

  • Geenaro is liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and under any guarantee given.
  • For slight negligence, Geenaro is liable only for breaching an obligation that is essential for the contract and that you may rely on, and only up to the damage that is typical and foreseeable for this kind of contract.
  • Any other liability is excluded. This also applies to Geenaro's helpers and representatives.
  • You are responsible for backing up your projects, sessions and files regularly. For lost data, Geenaro is liable only for the effort it would have taken to restore it from such backups.

10. Feedback and Bug Reports

Bug reports, ideas and other feedback you send may be used to fix and improve the products, without payment and without any obligation to act on them. Do not send anything you need to keep confidential.

11. Changes to These Terms

Geenaro may update these terms. The version shown when you buy applies to that purchase. For running subscriptions, changes are announced by email in advance; if you do not agree, you can cancel before they take effect.

12. Governing Law and Disputes

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory laws of the country where you live. If you are a merchant, the courts at Geenaro's place of business have jurisdiction. Geenaro is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

13. Severability

If any part of these terms is invalid, the rest stays in force, and the statutory rules apply in place of the invalid part.
